Terms of Service

1 About PukaWay

PukaWay is a delivery platform that connects customers with local vendors (restaurants and shops) and independent delivery riders in Ghana. PukaWay Technologies operates the platform but is not itself a food vendor or a delivery company. Vendors and riders are independent parties who use our platform to offer their services.

2 Eligibility

You must be at least 18 years old to create an account on PukaWay. By registering, you confirm that:

• You are 18 years of age or older
• You have the legal capacity to enter into a binding agreement
• All information you provide is accurate and up to date

3 User Accounts

You are responsible for keeping your account credentials secure. Do not share your password with anyone. You are liable for all activity that occurs under your account.

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or endanger the safety of other users.

4 Customers

• You may browse vendors, place orders, and pay through the PukaWay app.
• All prices displayed are set by the vendors. PukaWay does not set vendor pricing.
• You may cancel an order only while it is in pending or confirmed status. Once a vendor begins preparing your order, cancellation is no longer available.
• Delivery times are estimates. Actual delivery may vary due to traffic, weather, or vendor preparation time.
• If an order is not delivered due to an error on our part, contact us and we will investigate and offer a resolution.

5 Vendors

• Vendors must complete the onboarding process and be approved by PukaWay before accepting orders.
• Vendors are responsible for the accuracy of their menu, pricing, and product descriptions.
• Vendors must fulfill accepted orders promptly. Repeated cancellations or non-fulfillment may result in account suspension.
• Payouts are processed via Mobile Money after delivery confirmation. PukaWay retains a 10% platform fee on each order.
• Vendors must comply with all applicable Ghanaian food safety and business regulations.

6 Riders

• Riders must complete onboarding, provide valid identification and vehicle documentation, and be approved by PukaWay before accepting deliveries.
• Riders are independent contractors, not employees of PukaWay. PukaWay does not guarantee a minimum number of deliveries or earnings.
• Riders are responsible for obeying all traffic laws and operating their vehicles safely.
• Earnings are paid per completed delivery via Mobile Money.
• Accepting a delivery request and then abandoning it may result in suspension.

7 Payments

All customer payments are processed securely by Paystack, a PCI DSS-compliant payment processor. PukaWay does not store card details.

The platform also supports a PukaWay Wallet feature. Wallet top-ups are non-refundable except in cases of technical error. Wallet balances have no cash-out option for customers — they can only be used for orders on the platform.

In the event of a payment dispute, contact us through the official PukaWay support channel. We will investigate and respond within 5 business days.

8 Prohibited Conduct

You agree not to:

• Use PukaWay for any unlawful purpose
• Abuse, harass, or threaten other users, vendors, or riders
• Submit false orders or fraudulent payment information
• Reverse-engineer, scrape, or copy any part of the app
• Use automated bots or scripts to interact with the platform
• Attempt to access other users' accounts or data

Violation of these rules may result in immediate account termination and, where applicable, legal action.

9 Intellectual Property

All content in the PukaWay app — including the name, logo, design, code, and text — is owned by PukaWay Technologies. You may not reproduce, distribute, or create derivative works without our written permission.

Vendors grant PukaWay a non-exclusive licence to display their menu content, images, and store information within the app for the purpose of operating the platform.

10 Limitation of Liability

PukaWay provides the platform "as is." To the maximum extent permitted by Ghanaian law, we are not liable for:

• The quality, safety, or accuracy of food or goods sold by vendors
• Delays or failures in delivery caused by riders, traffic, or weather
• Loss or damage arising from your use or inability to use the app
• Any indirect, incidental, or consequential damages

Our total liability to you in any circumstances is limited to the amount you paid for the specific order that gave rise to the claim.

11 Governing Law

These Terms are governed by the laws of the Republic of Ghana. Any dispute that cannot be resolved informally will be submitted to the jurisdiction of the courts of Ghana.

12 Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last Updated" date above. Continued use of the app after changes are posted constitutes acceptance of the revised Terms. For significant changes, we will notify you via the app or email.
